To deepen the reform of the system for the disclosure of environmental information according to law, in accordance with the relevant provisions of the Reform Scheme for the System of Disclosure of Environmental Information According to Law (hereinafter referred to as the Reform Scheme) and the Measures for the Administration of the Disclosure of Enterprise Environmental Information According to Law (hereinafter referred to as the Administrative Measures), further refine the content of the disclosure of enterprise environmental information according to law, standardize the format of the disclosure of environmental information according to law, guide and assist enterprises in disclosing environmental information according to law, and comprehensively reflect the enterprise's compliance with ecological and environmental laws and regulations and environmental governance, the Ministry of Ecology and Environment recently issued and implemented the Guiding Principles for the Format of the Disclosure of Enterprise Environmental Information According to Law (hereinafter referred to as the Guiding Principles).
The Guiding Principles contain four chapters and thirty-one articles, which stipulate the content and format of the annual report on the disclosure of environmental information according to law (hereinafter referred to as the annual report) and the temporary report on the disclosure of environmental information according to law (hereinafter referred to as the temporary report). The annual report stipulates the specific content that should be disclosed, including a summary of key environmental information, basic enterprise information, enterprise environmental management information, information on pollutant generation, treatment and emission, and carbon emission information. The temporary report stipulates the environmental information that should be disclosed when an enterprise has changes in ecological and environmental administrative licenses, ecological and environmental administrative penalties, or ecological and environmental damage compensation. At the same time, it stipulates that when changes are made to the disclosed environmental information, the changes and the main basis should be disclosed. The Guiding Principles strengthen the standardization of environmental information disclosure, requiring that the information should be true, accurate, and objective, and that the language and expressions used should be easy to understand and easy for the public to understand.
The Ministry of Ecology and Environment will, together with the relevant departments of the central and state organs, ensure the implementation of the Guiding Principles, coordinate the Guiding Principles with the relevant information disclosure regulations for listed companies and debt-issuing enterprises, summarize practical experience in a timely manner, select typical cases and promote them, increase training and guidance for relevant enterprises, and promote the management departments and market entities to implement and utilize the Guiding Principles well, and guide the public and organizations to strengthen supervision.
